WCI employee charged with smuggling heroin, syringe to an inmate

Offense could bring more than 30 years in prison, thousands in fines

February 27, 2010 — CRESAPTOWN — A dietary officer at the Western Correctional Institution who admitted using heroin and attempting to smuggle it to an inmate is free on bond of $15,000 and will have a preliminary hearing in Allegany County District Court at 8:30 a.m. March 18.

Justin Wayne Smith, 27, Frostburg, was charged by Detective Sgt. Raymond Wills of the Department of Public Safety and Correctional Services Internal Investigative Unit on Feb. 12.

According to the statement of charges, a drug-detecting K-9 alerted, and Smith consented to a search of his vehicle in which a latex balloon containing heroin was discovered, as was a syringe.

Wills reported that Smith admitted to injecting heroin earlier that day and said he was attempting to smuggle the remaining heroin to inmate Frank Eubanks.

There are six charges against Smith, including intent to distribute, possession and intent to deliver drugs into an area of confinement. Combined, the charges could bring incarceration of more than 30 years and fines in excess of $65,000.

Smith is represented by Cumberland attorney Michal A. Noonan. Court records indicate that Smith had worked at WCI for six months.
