Frostburg man gets 25 years in home invasion, assault

CUMBERLAND — A Frostburg man was sentenced to a 25-year prison term Wednesday for the home invasion and assault of a Mount Pleasant Street woman in Frostburg in January and a burglary on Washington Street in Frostburg that occurred that same month.

The victim in the home invasion suffered a broken hip, broken wrist and head lacerations.

Zachary Lee Winner, 29, was sentenced in Allegany County Circuit Court to 25 years in the Maryland Division of Correction for his involvement in the assault of the 89-year-old victim, who was hospitalized following the incident.

Judge Gary G. Leasure sentenced Winner to 20 years for the  Jan. 21 assault and an additional five years for the Jan. 10 burglary of the Washington Street residence, according to State’s Attorney Michael Twigg.

The incident on Mount Pleasant Street occurred at 2 p.m. when Winner, wearing a hooded sweatshirt, knocked on the door, displayed a handgun, forced entry and then knocked the victim to the floor before sitting on her and yanking off her jewelry.

The arrest was made the day of the incident after Winner left the Frostburg residence of Melissa Ann McAteer, 21, who had reportedly failed to be truthful with police when she was asked if Winner was inside the residence.

McAteer pleaded guilty of obstruction of justice and was given a one-year jail term that was suspended, according to court records.

Police later recovered a toy handgun that was believed to be the weapon that was displayed during the home invasion.

Twigg acknowledged the work of Detective Vincent Benson of the Allegany County Sheriff’s Office and Detective Nicholas Costello of the Frostburg Police Department, who are both assigned to the C3I Unit.

Twigg also recognized Frostburg Police for its prompt response to the assault and the care that was provided to the victim.

“These burglaries and the assault of an elderly woman in our community were truly reprehensible,” Twigg said.

 “Mr. Winner will have a long time to reflect upon these offenses while he is incarcerated.”

The case was prosecuted by Twigg.

Winner was represented by attorney Michael Stankan of the Public Defender’s Office.
